Welcome to GuysTouch ("we," "us," "our," or the "Platform"), a social platform operated from Switzerland that helps adult men connect to exchange non-commercial touch, massage and companionship. By creating an account or otherwise using the Platform, you ("you," "User") agree to these Terms of Service ("Terms"). If you do not agree, do not use the Platform.
1. Eligibility — 18+ Only
The Platform is strictly for adults aged 18 years or older. By using GuysTouch you represent and warrant that you are at least 18, that all information you provide is true and accurate, and that you have the legal capacity to enter into these Terms. We reserve the right to suspend or terminate any account where we have reasonable doubt about a User's age.
2. Nature of the Service
GuysTouch is a discovery and messaging platform. We do not provide, organize, supervise, or participate in any in-person meeting, massage, touch session, or other interaction between Users. All interactions are arranged and carried out solely between Users at their own risk.
3. No Money Exchange — Non-Commercial Only
GuysTouch is for non-commercial peer exchange only. Users may not request, offer, accept, advertise or facilitate any payment, gift, tip, cryptocurrency, in-kind compensation, or other form of consideration in exchange for meeting, touch, massage, companionship, or any other activity between Users. Any commercial activity, escort services, prostitution, or sex work is strictly prohibited and will result in immediate account termination and may be reported to authorities.
4. Adult Interactions Between Consenting Adults
What consenting adult Users choose to do together in private is entirely their own business, provided it is lawful where they are, fully consensual, and involves no exchange of money or other consideration. GuysTouch takes no position on, and accepts no responsibility for, the nature of private interactions arranged between Users. Publicly posted content on the Platform must still comply with our content rules: no explicit sexual imagery in public profile photos, no content involving minors, and no non-consensual intimate content of any person.
5. User Conduct
You agree not to:
- Harass, threaten, stalk, intimidate, or impersonate any person
- Post unlawful, defamatory, hateful, or discriminatory content
- Share content involving minors of any kind
- Share non-consensual intimate images or content of any person
- Solicit, offer or accept money or anything of value
- Use the Platform for any illegal activity in your or anyone else's jurisdiction
- Attempt to access accounts, data, or systems you are not authorized to access
- Scrape, copy, or redistribute Platform content or User data
6. User-Generated Content
You retain ownership of content you upload (photos, messages, profile information). By posting, you grant GuysTouch a worldwide, royalty-free, non-exclusive license to host, display, reproduce, and distribute that content solely for the purpose of operating and promoting the Platform. You represent that you own or have all necessary rights to the content you upload and that it does not violate the rights of any third party.
7. Disclaimer of Warranties
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. To the maximum extent permitted by Swiss law, we disclaim all warranties including merchantability, fitness for a particular purpose, non-infringement, and any warranty that the Platform will be uninterrupted, secure, accurate, or error-free. We do not verify, endorse, or guarantee the identity, age, character, behavior, health status, or intentions of any User.
8. Assumption of Risk — Meetings Are at Your Own Risk
You acknowledge and agree that any decision to meet, communicate with, or share information with another User is made at your sole risk. GuysTouch does not perform background checks, identity verification (other than the optional verified-member badge), health screening, or criminal history checks on its Users. You are solely responsible for your own safety, due diligence, and choices.
9. Disputes Between Users — We Are Not a Party
Any dispute, claim, injury, loss, damage, or harm of any kind arising between Users — including but not limited to physical, emotional, psychological, financial, reputational, or property harm, sexually transmitted infections, theft, assault, or harassment — is solely a matter between the Users involved. GuysTouch is not a party to any such dispute, owes no duty in connection with it, and will not mediate, arbitrate, indemnify, compensate, or otherwise be liable. You agree to pursue any such claim exclusively against the other User(s) and not against GuysTouch, its operators, owners, employees, contractors, or affiliates.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, GUYSTOUCH AND ITS OPERATORS, OWNERS, OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM, INCLUDING WITHOUT LIMITATION ANY CONDUCT OR CONTENT OF OTHER USERS OR ANY IN-PERSON INTERACTION BETWEEN USERS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Our aggregate liability to you for any claim arising out of or related to these Terms or the Platform shall not exceed the greater of (a) the amount you paid us in the twelve (12) months preceding the event giving rise to the claim, or (b) CHF 100.
11. Indemnification
You agree to defend, indemnify, and hold harmless GuysTouch, its operators, owners, employees, contractors, and affiliates from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including legal fees) arising from: (i) your use of the Platform; (ii) your violation of these Terms; (iii) your violation of any third-party right, including intellectual property or privacy rights; (iv) any content you post; or (v) any interaction or dispute between you and another User.
12. Verified Membership
Optional paid verified membership provides a visual badge and trust signals. It does not constitute a background check or any warranty about the verified User's identity, character, health, or intentions. Membership fees are non-refundable except where required by Swiss consumer law.
13. Termination
We may suspend or terminate your account at any time, without notice, for any reason, including suspected violation of these Terms. You may delete your account at any time from Settings. Provisions that by their nature should survive termination (including Sections 7–11, 14, and 15) shall survive.
14. Governing Law and Jurisdiction
These Terms and any dispute between you and GuysTouch are governed exclusively by the laws of Switzerland, without regard to conflict-of-laws principles. The exclusive forum for any dispute between you and GuysTouch shall be the competent courts of Zurich, Switzerland, and you consent to personal jurisdiction there. Mandatory consumer protection rights in your country of residence are not affected.
15. Changes
We may update these Terms from time to time. Material changes will be communicated via the Platform or by email. Your continued use after changes become effective constitutes acceptance.
